Salvage may encompass towing, re-floating a vessel, or effecting repairs to a ship. Today, protecting the coastal environment from spillage of oil or other contaminants is a high priority. Before the invention of radio, salvage services would be given to a stricken vessel by any ship that happened to be passing by, nowadays most salvage is carried out by specialist salvage firms with dedicated crew and equipment. The legal significance of salvage is that a successful salvor is entitled to a reward, which is a proportion of the total value of the ship and its cargo. The amount of the award is determined subsequently at a "hearing on the merits" by a maritime court in accordance with Articles 13 and 14 of the International Salvage Convention of 1989. The common law concept of salvage was established by the English Admiralty Court, and is defined as " a voluntary successful service provided in order to save maritime property in danger at sea, entitling the salvor to a reward"; and this definition has been further refined by the 1989 Convention. Originally, a "successful" salvage was one where at least some of the ship or cargo was saved, otherwise the principle of "No Cure, No Pay" meant that the salvor would get nothing. In the 1970s, a number of marine casualties of single-skin-hull tankers led to serious oil spills. Such casualties were unattractive to salvors, so the Lloyds Open Form (LOF) made provision that a salvor who acts to try to prevent environmental damage will be paid, even if unsuccessful. This Lloyds initiative proved so advantageous that it was incorporated into the 1989 Convention. All vessels have an international duty to give reasonable assistance to other ships in distress in order to save life, but there is no obligation to try to salve the vessel. Any offer of salvage assistance may be refused; but if it is accepted a contract automatically arises to give the successful salvor the right to a reward under the 1989 Convention. Typically, the ship and the salvor will sign up to an LOF agreement so that the terms of salvage are clear. Since 2000, it has become standard to append a SCOPIC clause to the LOF, so as to circumvent the limitations of the "Special Compensation" provisions of the 1989 Convention (pursuant to the case of the Nagasaki Spirit).

Law of the Sea is a body of international law that concerns the principles and rules by which public entities, especially states, interact in maritime matters, including navigational rights, sea mineral rights, and coastal waters jurisdiction. It is the public law counterpart to admiralty law, which concerns private maritime intercourse. The United Nations Convention on the Law of the Sea, or "UNCLOS", concluded in 1982 and put into force in 1994, is generally accepted as a codification of customary international law of the sea. Disputes are resolved at the International Tribunal of the Law of the Sea (or "ITLOS"), a court in Hamburg. In 2017, ITLOS celebrated 20 years of existence, during which time it had settled some 25 cases. The Tribunal has jurisdiction over all disputes concerning the interpretation or application of the Convention, subject to the provisions of article 297 and to the declarations made in accordance with article 298 of the Convention. The judge are derived from a wide variety of nations. With many people worldwide now turning their eyes to an ocean in peril, the Law of the Sea convention turned into a global diplomatic effort to create a basis of laws and principles for all nations to follow concerning the sea and everything it held. The result: A 1982 oceanic constitution, called the United Nations Convention on the Law of the Sea. Between New York, USA and Geneva, Switzerland, ambassadors from 165+ countries sat down to trade and barter for their nations' rights. The conference created the standard for a 12-mile territorial sea around a land and allowed it to gain universal acceptance. Within these limits, states are free to enforce any of their own laws or regulations or use any resources. Furthermore, each signatory coastal state is granted an Exclusive Economic Zone (or "EEZ"), in which that state has exclusive rights to fisheries, mineral rights and sea-floor deposits. The Convention allows for "innocent passage" through both territorial waters and the EEZ, meaning merchant ships do not have to avoid such waters, provided they do not do any harm to the country or break any of its laws. Military ships do NOT have the right to pass through another nation's EEZ unless permission is granted. This can cause difficulties for Russia, whose Baltic fleet and Black Sea fleet do not have unobstructed access to the great oceans. By contrast, the USA (which is not a signatory to UNCLOS) has free access to the Atlantic, Pacific and Arctic oceans, and to the Gulf of Mexico. Because the EEZ is so extensive, ITLOS may need to determine the ocean boundaries between states, as they did in 2012 between Bangladesh and Burma (Myanmar). As the Arctic Ocean becomes increasingly important for both navigation and resources, the USA may find it necessary to submit to UNCLOS to clarify the Alaska/Canada border. The Law of the Sea should be distinguished from Maritime Law, which deals with topics such as law of carriage of goods by sea, salvage, collisions, marine insurance and so on. In maritime law disputes, normally at least one party is a private litigant, such an individual or a corporation.

International Safety Management Code (ISM)

The purpose of this Code is to provide an international standard for the safe management and operation of ships and for pollution prevention. The Code establishes safety-management objectives and requires a safety management system (SMS) to be established by "the Company", which is defined as the shipowner or any person, such as the manager or bareboat charterer, who has assumed responsibility for operating the ship. The Company is then required to establish and implement a policy for achieving these objectives. This includes providing the necessary resources and shore-based support. Every company is expected "to designate a person or persons ashore having direct access to the highest level of management". The procedures required by the Code should be documented and compiled in a Safety Management Manual, a copy of which should be kept on board. Admiralty law (also referred to as maritime law) is a distinct body of law which governs maritime questions and offenses. It is a body of both domestic law governing maritime activities, and private international law governing the relationships between private entities which operate vessels on the oceans. It deals with matters including marine commerce, marine navigation, marine salvaging, shipping, sailors, and the transportation of passengers and goods by sea. Admiralty law also covers many commercial activities, although land based or occurring wholly on land, that are maritime in character. We will be salvaging driftwood from beaches and making it into valuable roofing products; western red cedar shakes. Not all of the driftwood on a beach is good for making handsplit cedar shakes. We will have to search through it, identifying the different tree species, and selecting only the red cedar. Not only that, but we must find pieces of red cedar, known as slabs, that are strips of very large cedar trees. This will give us the quality of wood that is needed for the making of handsplit shakes. All of the driftwood behind me, on this beach, is the result of logging. Trees are harvested, transported to the ocean, then through the ocean via log booms or log carrying barges. Occasionally this harvested wood slips out of the log boom or, or falls off the log carrying barge, floats around at the whim of the tide and currents, and finally ends up here. On the beach. As you can see behind me that driftwood comes in all shapes and sizes. Much of it is ground up on the beach from the constant wave action. This makes some of it difficult to identify. Some has been here for years, while other wood is just arriving now. The extreme high tides of winter shifts wood from one beach to another. A rocky or pebble beach is preferred as embedded sand from a sandy beach can make chainsawing the driftwood difficult. Some beaches contain a large amount of salvageable wood, others contain none. Much of it is luck, and whether someone else has salvaged the beach before you got there. This item may or may not be western red cedar. When salvaging it I will cut into it and sample the smell of the wood to be sure. Showing a wide grain and a few knots, this item does not look too promising. I may be able to get two twenty-four inch slices from it, between the knots and other defects. This item is certainly western red cedar and is a short slab from a very large tree. One end is slightly checked, or cracked, but the other shows signs of promise. Before cutting I will lift it from the sand and remove any chainsaw dulling sand and gravel. When beach combing one does not only find driftwood. All sorts of floating debris washes up on beaches, such as this piece of styro foam and this bouncy ball. I am sure you have heard of the rash of human feet inside shoes that have been washing up on beaches in the area around Vancouver, BC, Canada. Much of what you find is simply garbage, but sometimes you get lucky, or unlucky in the case of the human feet. This item, the most promising yet on this beach, is typical of what we are looking for. It may look like a small tree but in reality it is a strip of a cedar tree that could be over 1000 years old. Virtually free of defects, this piece will almost certainly yield an adequate amount of fine handsplit cedar shakes. This fine specimen is long, straight and free of defects. Unfortunately it is yellow cedar, or sometimes known as cypress. Yellow cedar only grows at higher altitudes and is most likely from the central Vancouver island region. Generally stringy and tough to split, this piece is better suited to be cut up into lumber using a band saw mill. The rope attached indicates that it has already been claimed by another beach comber. The unwritten rule clearly states that if a rope is attached, holding it to the shore, the piece is already spoken for. The logistics of getting this piece to a saw mill is far more difficult than salvaging the small and easy to handle cedar blocks used when producing hand split shakes. When trying to tell the difference between red and yellow cedar, remember this; sometimes red cedar can appear yellowish. If its yellow and you cant tell the difference, then its red cedar. Yellow cedar is a very distinctive yellow and cannot be confused with red cedar.

Natural Sound A cargo ship burned in the English Channel on Wednesday as investigators tried to explain how it collided with a cruise ship in good weather and in a tightly controlled shipping lane. Some 21 passengers and eight crew on the Norwegian Cruise Line ship suffered minor injuries in the collision with the Taiwanese cargo ship Ever Decent on Tuesday off Britain's southeast coast. The cargo ship remained at sea under a cloud of smoke as crew members and firefighters battled a blaze that broke out as a result of Tuesday's crash. Meanwhile the cruiser arrived later at the British port of Dover, 40 miles (72 kilometres) from the scene of the accident, with all passengers on board. By late Tuesday, the fire was under control and firefighters were lifted off the ship by helicopter. Three salvage tugs remained at the scene to flood the vessel's deck with water in an effort to extinguish the flames. Authorities were at a loss to explain how the accident happened. Coastguard officials in Dover said there no sign of trouble before the collision. Neither vessel sent a distress message, or any indication of trouble prior to the crash. Both ships were in a recognised crossing point of the shipping lane, officials said. Strict separation rules are in effect for the area, and both ships were equipped with modern radar systems. The Ever Decent was traveling from the River Thames to Zeebrugge in Belgium, while the Norwegian Dream cruise liner was returning to port at Dover after a 13-day tour of Scandinavian capitals. It had 1-thousand- 726 passengers on board. The force of the collision threw three shipping containers from the deck of the Ever Decent onto the 41-thousand tonne cruiser. Other containers fell in the water, while several more caught fire, the Coastguard said. The collision crushed part of the bow of the Norwegian Dream. Here is the press release from this incident. At a hearing 30/05/2011 at Southampton Magistrates the Officer of the Watch of a fishing vessel pleaded guilty to one safety charge brought under Section 58 of the Merchant Shipping Act 1995. He was fined £1,700 plus costs of £6,435. On the 20th August 2010 the Andrea had finished fishing and was returning to port in the Netherlands. The skipper and rest of the crew were below leaving Jan Baarssen alone on the bridge in sole charge of the vessel. The Andrea is a 36.5 metre beam trawler registered in the UK but is based in the Netherlands The Alexander von Humboldt was returning to Germany after a training voyage with a crew of fifty nine (59) consisting of thirty three (33) trainees and twenty six (26) full time crew. She is a large three masted sail training vessel registered in Germany. The visibility on the day was good (10 Km +), wind was southerly force 5-6 with weather being grey and overcast. During the afternoon of the 20th August 2011 the Alexander von Humboldt detected the Andrea on a steady bearing on its port side. The Andrea was not fishing and was the give way vessel. The Alexander von Humboldt started sounding its whistle. The Andrea failed to give way. The Alexander von Humboldt also tried to contact the Andrea by VHF radio but had no response. The Andrea claims to have gone hard to starboard and when within 15-20 metres of the Alex von Humboldt, the Andrea was seen to go full astern. The Andrea struck the port quarter of the Alexander von Humboldt. It was a fairly low speed collision. Apart from some scratched paintwork, the Andrea was undamaged. The Alexander von Humboldt was lucky to suffer only some dented shell plating with associated damage to internal wooden bulkheads and deck planking together with bent or buckled handrails. It was very fortunate that no harm came to the crew of the Alexander von Humboldt and that its rigging and watertight integrity remained intact. Mr Jan Baarssen, 51, of Urk, Netherlands pleaded guilty for conduct endangering ships or persons. He was finerd£1,700 plus costs of £6,435 In passing sentence the Magistrates stated that it was fortunate that they were no injuries especially among the sail training crew. Mr David Fuller O.B.E., Principal Fishing Vessel Surveyor for the Eastern Region of the MCA stated:"This is yet another incident occurring on the return of a fishing vessel to harbour. Fishermen are reminded of the requirement to keep a good lookout at all times. Also that that the trip is not over until the vessel is safely tied up in port. We would like to thank the German and Netherlands Police for their assistance in this matter"

The Sinking of R.M.S. Lusitania

•Information: RMS Lusitania was a British ocean liner and briefly the world's largest passenger ship. The ship was sunk on 7 May 1915 by a German U-boat 11 mi (18 km) off the southern coast of Ireland. The sinking presaged the United States declaration of war on Germany (1917). Lusitania was a holder of the Blue Riband appellation for the fastest Atlantic crossing, and was briefly the world's largest passenger ship until the completion of her sister ship Mauretania, three months later. The Cunard Line launched Lusitania in 1906, at a time of fierce competition for the North Atlantic trade. She sank on her 202nd trans-Atlantic crossing. German shipping lines were aggressive competitors for the custom of transatlantic passengers in the early 20th century. In the face of the competition, Cunard responded by trying to outdo them in speed, capacity, and luxury. Cunard used assistance from the British Admiralty to build Lusitania, on the understanding that the ship would be available as a light merchant cruiser in time of war. Lusitania had gun mounts for deck cannons, but no guns were ever installed. Both Lusitania and Mauretania were fitted with revolutionary new turbine engines that enabled them to maintain a service speed of 25 knots (46 km/h; 29 mph). They were equipped with lifts, wireless telegraph and electric light, and provided 50% more passenger space than any other ship; the first class decks were noted for their sumptuous furnishings. The Royal Navy had blockaded Germany at the start of the First World War. The UK declared the entire North Sea a war zone in the autumn of 1914, and mined the approaches; in the spring of 1915 all food imports for Germany were declared contraband. When RMS Lusitania left New York for Britain on 1 May 1915, German submarine warfare was intensifying in the Atlantic. Germany had declared the seas around the United Kingdom a war zone, and the German embassy in the United States had placed newspaper advertisements warning people of the dangers of sailing on Lusitania. On the afternoon of 7 May, a German U-boat torpedoed Lusitania 11 mi (18 km) off the southern coast of Ireland and inside the declared war zone. A second, unexplained, internal explosion, sent her to the seabed in 18 minutes, with the deaths of 1,198 passengers and crew. The Germans justified treating Lusitania as a naval vessel because she was carrying hundreds of tons of war munitions, therefore making her a legitimate military target, and argued that British merchant ships had violated the Cruiser rules from the very beginning of the war. The internationally recognized Cruiser rules were obsolete by 1915 - with the British introduction of Q-ships in 1915 with concealed deck guns, it had become more dangerous for submarines to surface and give warning. (Lusitania had been fitted with 6-inch gun mounts in 1913, although no guns were mounted at the time of her sinking.) RMS Lusitania was regularly transporting war munitions, she operated under the control of the Admiralty, she could be converted into an armed auxiliary cruiser to join the war, her identity had been disguised, and she flew no flags. She was a non-neutral vessel in a declared war zone, with orders to evade capture and ram challenging submarines. However the ship was technically unarmed and was carrying thousands of civilian passengers, and so the British government accused the Germans of breaching the Cruiser Rules. The sinking caused a storm of protest in the United States because 128 American citizens were among the dead. The sinking helped shift public opinion in the United States against Germany and was one of the factors in the United States' declaration of war nearly two years later. After the First World War, successive British governments maintained that there were no munitions on board Lusitania, and the Germans were not justified in treating the ship as a naval vessel.
